Hedgeye Risk Management today released its written case against U.S. energy pipeline operator Kinder Morgan and its related entities.

All four of the tickers Hedgeye suggests shorting instead rallied between 1% and 2% today. While it’s a good day for Mr. Market, clearly investors don’t think the short case delivered enough punch.

In a nutshell: Hedgeye says investors should worry more about Kinder’s pipeline maintenance and spending therein. And �it says Kinder’s exploration and production business, while small, is NOT a pipeline enterprise and valuation should reflect that.��Moreover, Hedgeye says it thinks �Kinder Morgan�� strategy is to “starve its pipelines and related infrastructure of routine maintenance spending” so that it can maximize distributable cash flow and payments to the general partner, Kinder Morgan�(KMI). As a structure,�MLPs pay out most of their cash flow as tax-deferred distributions to investors in their “units,” as shares are called.

The company yesterday said it will sell about 9 million units at $1.40 a unit for proceeds of about $12.6 million. The cash generated will be used to fund working capital, support growth and general corporate purposes, the company said.

On Jul 12, we maintained our Underperform recommendation on Itron, Inc. (ITRI) based on decline in bookings and backlog, a challenging U.S. market, muted spending in European countries and recent weakness in the Latin American residential business.

Why Reiterated?

Itron�� first-quarter 2013 adjusted earnings fell 66% year over year to 31 cents per share, while revenues dipped 22% to $448 million. The decline in revenues was mainly due to the Energy segment after the completion of several OpenWay projects in North America.

The company witnessed surprisingly weak demand trends in January/February. Though it somewhat improved in March/April, there were some regional issues. Given the weak start to the year, Itron will need contribution from new large contract wins to achieve its full-year growth target. Furthermore, the completion of the OpenWay projects is expected to impact revenues negatively in the next few quarters.

Itron�� bookings in the quarter declined to $447 million from $467 million in the preceding quarter and backlog at the end of the quarter was $1.029 billion versus $1.035 billion at the end of the fourth quarter of 2012.

    In the latest move in a broad deleveraging effort, Spanish telecom incumbent Telefonica (NYSE: TEF  ) has divested one of its European subsidiaries. The company announced that it has reached agreement to sell Telefonica Ireland to Hong Kong-based conglomerate Hutchison Whampoa Group. The potential total price is 850 million euros ($1.1 billion), 780 million euros ($1.0 billion) of which will be handed over at the closing of the transaction while 70 million euros�($92 million) will take the form of a deferred payment to be transferred when certain financial objectives are met.

The Company generally receives a percentage of the theater box-office receipts as a distribution fee. Films produced by the Company are typically financed through third parties, whereby the Company will generally receive a film production fee in exchange for producing the film and a distribution fee for distributing the film. The Company utilizes third-party funding for the majority of original films it produces and distributes. In 2012, the Company, along with Warner Bros. Pictures (WB) and MacGillivray Freeman Films (MFF) released an original title, To the Artic 3D: An IMAX 3D Experience.

The Company derives a small portion of its revenues from other sources. As of December 31, 2012, the Company had four owned and operated theaters. In addition, the Company has a commercial arrangement with one theater resulting in the sharing of profits and losses and provides management services to two theaters. The Company also rents its two dimensional (2D) and three dimensional (3D) large-format film and digital cameras to third party production companies. The Company maintains cameras and other film equipment and also offers production advice and technical assistance to both documentary and Hollywood filmmakers. First Cash Financial Services, Inc., incorporated on April 24, 1994, is an operator of retail-based pawn and consumer finance stores in the United States and Mexico. As of February 18, 2013 , the Company had approximately 829 locations twelve states in United States and 24 states in Mexico. The Company's primary business is the operation of pawn stores, which engage in retail sales, purchasing of secondhand goods and consumer finance activities. Pawn Merchandise Sales

The Company also melts down certain quantities of scrap jewelry and sells the gold, silver and diamonds in commodity markets.

The Company acquires pawn merchandise inventory primarily through forfeited pawn collateral and, to a lesser extent, through purchases of used goods directly from the general public. Merchandise acquired by the Company through forfeited pawn collateral is carried in inventory at the amount of the ! related pawn loan, exclusive of any accrued service fees. The Company does not provide financing to customers for the purchase of its merchandise, but does permit its customers to purchase merchandise on an interest-free layaway plan. Should the customer fail to make a required payment, the item is returned to inventory and previous payments are forfeited to the Company. Interim payments from customers on layaway sales are credited to deferred revenue and subsequently recorded as income in which final payment is received or when previous payments are forfeited to the Company.

Pawn Lending Activities

The Company's pawn stores make small loans to their customers in order to help them meet short-term cash needs. All pawn loans are collateralized by personal property such as jewelry, electronic equipment, household appliances, tools, sporting goods and musical instruments. Pawn loans are non-recourse loans and the pledged goods provide the only security to the Company for the repayment of the loan. At the time a pawn transaction is entered into, an agreement, commonly referred to as a pawn ticket, is delivered to the borrower for signature that sets forth, among other items, the name and address of the pawnshop, borrower's name, borrower's identification number from his/her driver's license or other identification, date, identification and description of the pledged goods, including applicable serial numbers, amount financed, pawn service fee, maturity date, total amount that must be paid to redeem the pledged goods on the maturity date, and the annual percentage rate. Pledged property is held through the term of the loan, unless the pawn is paid earlier or renewed. The typical loan term is generally one month plus an additional grace period (typically 30 to 90 days). The Company contracts for pawn loan fees and service charges as compensation for the use of the funds loaned and to cover direct operating expenses related to the transaction and holding the pledged property. These pa! wn loan f! ees and service charges accounted for approximately 26% of the Company's revenue from continuing operations during the year ended December 31, 2012 .

Credit Services and Consumer Loan Activities

The Company has significantly reduced its U.S.-based consumer loan activities, primarily from payday lending, over the past several years. In September 2012, the Company closed seven of its consumer loan stores located in the Texas cities of Austin and Dallas. The Company offers a fee-based credit services organization program (CSO Program) to assist consumers, in Texas markets, in obtaining extensions of credit. The Company's consumer loan and pawn stores in Texas offer the CSO Program, and, in Texas, credit services are also offered via an Internet platform. Under the CSO Program, the Company assists customers in applying for a short-term extension of credit from an independent, non-bank, consumer lending company (the Independent Lender) and issues the Independent Lender a letter of credit to guarantee the repayment of the extension of credit.

The Company subsequently collects a percentage of these bad debts by redepositing the customers' checks, ACH collections or subsequent cash repayments by the customers. The profitability of the Company's credit services operations is dependent upon adequate collection of these returned items. The Company also offers an automobile title lending product under the CSO Program. These credit services fees accounted for approximately 8% of the Company's revenue from continuing operations during 2012 . In Mexico, the Company also offers an installment loan product with a term of 365 days and bears weekly service fees of 7% on the loan amount. These consumer loan fees accounted for less than 1% of the Company's revenue from continuing operations during 2012 .

Although the Bank of Canada (BoC) would like to see the country�� economy transition away from its dependence on debt-burdened consumers, Canadian spending remains surprisingly resilient.

According to Statistics Canada (StatCan), April retail sales grew 1.1 percent month over month, to CAD41.6 billion, nearly double economists��consensus forecast of 0.6 percent.

Total retail turnover was up 5.1 percent year over year. By contrast, US retail sales were up 4.6 percent over that same trailing-year period.

With the March figure revised to a 0.1 percent increase from the previously reported decline of 0.1 percent, that makes April the fourth consecutive month in which retail turnover has risen. US retail sales enjoyed a similar four-month streak from February through May.

StatCan notes that gains were widespread across Canada�� retail sector during April, as�10�of�11�subsectors posted increases.
