With Hippocratic Oath, Doctors Pledge Allegiance to Patients, Not Profits

The Maine Medical Association recently updated a 2008 poll of their members that asked the question, �When considering the topic of health care reform, would you prefer to make improvements in the current public/private system (or) a single-payer system, such as a �Medicare-for-all� approach?� In 2008, 52.3 percent favored the Medicare-for-all approach. In the updated poll, released last week, that number had risen to 64.3 percent.

It�s pretty unusual for two-thirds of a group of doctors to agree on something as controversial as a single-payer health care system. Until recently, doctors formed the core resistance to �government-run� health insurance in the U.S.

A number of factors account for this impressive change, but the huge administrative burden on practicing physicians created by our plethora of private insurance schemes is certainly near the top of the list.

The other day, I spoke with a Maine physician nearing retirement and looking forward to it. She was recently returning home after a long day in her practice, carrying her �homework,� a pile of administrative paperwork several inches high. Her husband asked her how she got so far behind in her paperwork. �I wasn�t behind at all,� she replied. She did this much paperwork, mostly insurance forms, at least twice a week.

American physicians spend at least three times as much time, money and effort on administrative work related to payment and insurance coverage as our Canadian brethren, with their single-payer system. Administrative hassle is a major factor driving more and more American doctors to sell our practices to large corporations that take care of the back-office work. The Affordable Care Act has only added to that burden. Sixty percent of doctors now work for corporations, and that number is growing.

Working for a corporate provider of health care services is a mixed bag. He who pays the piper calls the tune. As both for-profit and nonprofit health care corporations have become increasingly focused on the bottom line, doctors working for them have come under increasingly subtle and not-so-subtle pressures to generate revenue for their employers.

Some tests and procedures are more profitable than others. Increasingly, doctors� �productivity� is measured by the amount of profitable revenue we produce rather than by the results we get for our patients. But in health care, profitability is a very unreliable measure of value because doctors� fees and other health care prices are often set arbitrarily.

When we graduate from medical school, most of us take the Hippocratic Oath, swearing our primary allegiance to our patients. Young doctors tend to take their oath very seriously. Most doctors truly want to do what�s best for patients, not their insurance company or our employers� bottom line.

But in today�s corporatized and increasingly monetized health care environment, the demands for generation of profit often directly conflict with our clinical judgment. The belief that doctors and other healers act as stewards for our patients� welfare has long earned us a special place in society and the trust of our patients. That position and that trust, so critical to healing, is now threatened.

This conflict has made many doctors very angry. Practicing a profession that has traditionally been a calling has become a business. Doctors today are caught in a system corrupted by an excessive focus on money that is forcing us to behave in ways that conflict with our professional ethics. We are growing very tired of being told how to practice medicine by insurance company bureaucrats and corporate MBAs.

This is another major cause of the burnout experienced by increasing numbers of doctors. Many older doctors are now simply looking for a way out. Others are calling for systemwide reforms that will allow them to return to focusing on the welfare of their patients. Hence the results of the recent MMA poll.

In an excellent new book called �What Matters In Medicine�, longtime Maine family doctor David Loxterkamp points out that medical care, while often using scientific jargon, methods and tools, is at its core a profession about relationships, not profits. That�s something the bean-counters and policy wonks who have become increasingly influential in determining the nature of our corporatized health care system seem unable to understand.

It�s time to remove corporate profit from the financing of health care, and perverse financial incentives from the direct provision of services. It�s time for improved Medicare-for-all.

    The hits keep coming at high-end retailer Nordstrom (JWN).

    After reporting a decline in fourth-quarter earnings and weak sales, shares traded down 0.3% to $59.24 today. And Sterne, Agee & Leach's Charles Grom, while acknowledging that the fourth quarter was "OK," warned that there were issues developing undern! eath. He explains:

    Beneath the surface, there are two disturbing trends emerging that shouldn't go unnoticed, including: 1) a more promotional environment/gross profit margin risk (as Nordstrom price matches); and 2) full line cannibalization (via e-commerce), which structurally compresses Nordstrom's top-line algo. All told, the Nordstrom experience is one of the best in retail, but the stock is dead money for the foreseeable future, in our view.

    Grom accentuated a few positives that included a rise in same-store sales by 2.6% and decent earnings. A rise in inventory levels and lower EPS guidance were some of the negatives, Grom said.

    Nordstrom’s pain didn’t cause stand in the way of gains for some other department store stocks. Dillard’s (DDS) gained 1.5% to $89.33, while Macy’s (M) rose 0.5% to $53.71. Even J.C. Penney (JCP) had a better day. It finished down just 0.2% at $5.64.

    Stifel reported on Friday that it has cut Nordstrom, Inc. (JWN) from “Buy” to Hold.”

    Analyst Richard Jaffe said that although JWN reported strong fourth quarter results, the company’s weak outlook for 2014 is a concern. The analyst noted that JWN’s Q4 results were “cautious given the current retail environment and the additional expenses related to Canada expansion, technology investments and accelerated Rack pre-opening costs.”

    The analyst also noted that “management has taken a long-term view, recognizing that the retail world is changing rapidly and dramatically, and has adjusted its growth investments to be consistent with the changing environment. Nordstrom has focused its efforts on the e-commerce business, the Rack off-price business and the new markets of Canada and New York City. These investments are different than prior investments and differ greatly from the investment in a new Nordstrom full-line store.”

    Regarding the company’! s expansi! on to Canada, Jaffe said: “Canadian retail real estate in prime locations is different than the US. There are fewer high quality locations and as a result they are costly; requiring upfront expenditures, build-out expenses and monthly rent to be paid. The analyst notes that population density is better around larger cities in Canada.”

    Nordstrom shares were down $1.24, or 2.09%, during pre-market trading Friday. The stock is down 3.82% YTD.

Diamondback Energy, Inc., incorporated on December 30, 2011, is an independent oil and natural gas company. The Company is focused on the acquisition, development, exploration and exploitation of unconventional, onshore oil and natural gas reserves in the Permian Basin in West Texas. The Company is the operator of Janey 16H in Upton County with a 3,842 foot lateral in the Wolfcamp B interval. During the year ended December 31, 2012, the Janey 16H had produced a total of 48 thousand barrels of oil and 62 million cubic feet of natural gas. As of December 31, 2012, the Company had drilled 193 gross (176 net) wells, and participated in an additional 18 gross (eight net) non-operated wells, in the Permian Basin. Of these 211 gross wells, 191 were completed as producing wells and 20 were in various stages of completion. In the aggregate, as of December 31, 2012, it held interests in 225 gross (201 net) producing well in the Permian Basin.

The Company's activities are primarily focused on the Clearfork, Spraberry, Wolfcamp, Cline, Strawn and Atoka formations, which it refers to collectively as the Wolfberry play. The Wolfberry play is characterized by high oil and liquids rich natural gas, multiple vertical and horizontal target horizons, extensive production history, long-lived reserves and high drilling success rates. The Wolfberry play is a modification and extension of the Spraberry play, the majority of which is designated in the Spraberry Trend area field. As of December 31, 2012, its estimated proved oil and natural gas reserves were 40,210 million barrels of oil equivalent based on a reserve report prepared by Ryder Scott Company L.P. (Ryder Scott), its independent reserve engineers. Of these reserves, approximately 29.5% are classified as proved developed producing, (PDP). Proved undeveloped (PUD), reserves included in this es! timate are from 306 vertical gross well locations on 40-acre spacing and four gross horizontal well l ocations. As of December 31, 2012, these proved reserves wer! e approximately 65% oil, 21% natural gas liquids and 14% natural gas.

The Company had have 881 identified potential vertical drilling locations on 40-acre spacing based on its evaluation of applicable geologic and engineering data as of December 31, 2012, and had an additional 1,118 identified potential vertical drilling locations based on 20-acre downspacing. It also has identified 731 potential horizontal drilling locations in multiple horizons on its acreage. The Company's second horizontal well, Kemmer 4209H in Midland County is a non-operated well in which the Company owns a 47% working interest. In 2012, the Kemmer 4209H produced a total of 41 thousand barrels of oil and 45 million cubic feet of natural gas. In addition to the Janey and Kemmer wells, as of February 28, 2013, the Company had three additional horizontal wells in Midland County and four horizontal wells in Upton County in various stages of development. In Midland County, it drilled the ST25 -1H well (83% working interest) with a lateral length of 4,617 feet.

In Upton County, the Company drilled three additional wells, the Neal 8-1H (100% working interest) with a lateral length of 7,652 feet, the Neal 8-2H (100% working interest) with a lateral length of 6,658 feet and the Janey 3H (100% working interest) with a lateral length of 4,629 feet. It completed a 32 stage frac on the Neal 8-1H well in January 2013. As of February 26, 2013, flowback operations were underway and for the last seven days the well averaged 806 barrel of oil equivalent per day with a peak rate of 871 barrel of oil equivalent per day with an 85% oil component.

    One under-$10 biopharmaceutical player that's starting to move within range of triggering a big breakout trade is Cardiome Pharma (CRME), which engages in the discovery, development and commercialization of therapies that enhance the health of patients. This stock has been on fire over the last three months, with shares up sharply by 43%.

    If you take a look at the chart for Cardiome Pharma, you'll notice that this stock has been trading range boun! d for the last month or so, with shares moving between $5.85 on the downside and $7.15 on the upside. Shares of CRME have now started to bounce higher off that big support level near $6 a share and it's quickly moving within range of triggering a big breakout trade above some key near-term overhead resistance levels.

    Traders should now look for long-biased trades in CRME if it manages to break out above some near-term overhead resistance levels at $6.95 to its 52-week high at $7.15 a share with high volume. Look for a sustained move or close above those levels with volume that hits near or above its three-month average volume of 123,602 shares. If that breakout triggers soon, then CRME will set up to enter new 52-week-high territory, which is bullish technical price action. Some possible upside targets off that breakout are $9 to $10 a share.

    Traders can look to buy CRME off any weakness to anticipate that breakout and simply use a stop that sits right below some key near-term support levels at $6 or $5.85 or near its 50-day moving average of $5.63 a share. One can also buy CRME off strength once it starts to take out those breakout levels with volume and then simply use a stop that sits a comfortable percentage from your entry point.

    Well, that answers that question. Questerre Energy Corp. (TSE:QEC) and Crescent Point Energy Corp. (TSE:CPG) likely knew they had some shale-oil mining neighbors in the Bakken Shale neighborhood in Saskatchewan, Canada, but they hadn't seen much of that competition. That's about to change soon. Adequately funded and eager to begin laying its final mining plans, Centor Energy Inc. (OTCBB:CNTO) is going to officially own 55% of a 21,000 acre shale oil property that's anywhere from just a few miles away to just a few meters away from and Crescent Point Energy's and Questerre Energy's operations in one of the oil-richest known areas in the Bakken formation. And to be clear, it's not like Centor Energy is just getting the ball rolling; the planning for this project has been underway for months. Once the property-acquisiti! on deal is inked in mid-February, CNTO will likely finish up its feasibility study and begin the approval process for its facility later in the year. That's pr etty quick, but as was noted, a great deal of the legwork has already been done.

    While the Bakken formation is already on most investor radars, few American investors may realize that the formation stretches North into the oil and gas rich Canadian province of Saskatchewan where stocks like Surge Energy Inc (TSE: SGY), Questerre Energy Corp (TSE: QEC), Crescent Point Energy Corp (TSE: CPG), Keyera Corp (TSE: KEY) and Centor Energy Inc (OTCBB: CNTO) have been pumping out a good flow of newsworthy news in recent weeks.     Among its peers in the MLP and LLC space, LINN by far hedges the most production. BreitBurn Energy Partners (NASDAQ: BBEP  ) , for example, has hedged roughly 75% of its production through 2015, whereas LINN is 100% hedged through 2016. BreitBurn almost exclusively uses swaps as its hedge of choice. It's a similar story at Vanguard Natural Resources (NASDAQ: VNR  ) , which also uses swaps to almost exclusively hedge natural gas while using three-way collars to hedge about a third of its oil production. While LINN could get more creative, one thing I'd be surprised to hear is that it's going to join these two peers and leave some of its production unhedged.

    From a technical perspective, YZC bounced sharply higher here right off some near-term support at $6.77 with above-average volume. This stock has been downtrending badly for the last six months, with shares plunging from its high of over $14 to its recent low of $6.68. During that move, shares of YZC have been consistently making lower highs and lower lows, which is bearish technical price action. That said, shares of YZC have recently formed a double bottom chart pattern at $6.68 to $6.77. This stock now looks ready to reverse that downtrend and possibly trigger a near-term breakout trade. That trade will hit if YZC manages to take out some near-term overhead resistance levels at $7.76 to $8 with high volume.

    Traders should now look for long-biased trades in YZC as long as it's trending above its recent low of $6.77 and then once it sustains a move or close above those breakout levels with volume that hits near or above 370,383 shares. If that breakout triggers soon, then YZC will set up to re-test or possibly take out its next major overhead resistance levels at $9 to $10. Any high-volume move above those levels will then give YZC a chance to tag its next major overhead resistance levels at $10.67 to $11.11
